1. Introduction

Welcome to EterniHost, powered by Guardians Technologies (Pvt) Ltd. By using our services, you agree to be bound by these Terms of Service ("TOS") and our Privacy Policy. These terms apply to all customers who purchase or use our hosting services.

2. Account Management

Clients are required to maintain accurate and up-to-date account information. Users are responsible for the confidentiality of their account login details. Account suspension or termination may occur if terms are violated, including but not limited to fraudulent activities or failure to pay.

3. Service Interruptions and Liability

EterniHost’s services are subject to interruptions for reasons beyond our control, including but not limited to natural disasters, system failures, or issues with third-party providers. We cannot be held liable for any damages arising from such interruptions.

Clients acknowledge that, in the event of service interruptions or issues, our liability shall be limited to the charges paid by the client for the affected service during the period the issues occurred. In no event shall EterniHost be held responsible for any indirect, special, incidental, or consequential damages.

4. Indemnification Policy

You agree to use all EterniHost services and facilities at your own risk. EterniHost disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall EterniHost be liable for any loss, data loss, or other commercial damage, including but not limited to special, incidental, or consequential damages.

Clients agree to defend, indemnify, and hold harmless EterniHost and its affiliates from any and all demands, liabilities, losses, costs, and claims arising from any service provided, product sold, or any injury to person or property caused by the client’s use of the service.

5. Acceptable Use Policy (AUP)

Clients agree to adhere to the following usage policies to ensure a safe and fair hosting environment:

Prohibited Content

  • Illegal, harmful, or fraudulent content, including copyright-infringing material, child exploitation material, or content that promotes violence or hatred.
  • Malicious scripts, malware, or any material designed to disrupt, harm, or gain unauthorized access to other systems.

Prohibited Activities

  • Sending unsolicited emails (spam) or operating bulk email lists.
  • Using shared hosting services for cryptocurrency mining or other high-resource activities that degrade service quality for others.
  • Running scripts, bots, or applications that overburden server resources.

Security Obligations

  • Clients must maintain the security of their account credentials and update software hosted on their accounts to prevent vulnerabilities.
  • Clients may not use EterniHost services to distribute or facilitate Distributed Denial of Service (DDoS) attacks or other malicious actions.

Resource Usage

  • Accounts may not exceed the allotted CPU, RAM, or disk space specified in their hosting plan.
  • EterniHost reserves the right to suspend or throttle services for accounts using excessive resources or negatively impacting server performance.

6. Service Removal & Copyright Infringement

EterniHost reserves the right to intervene with any website or data hosted on its servers or network in the interest of its clients. Any material that infringes or allegedly infringes on the proprietary rights of a third-party copyright owner is subject to removal. EterniHost shall be the sole judge of what violates this policy.

7. Refund Policy

EterniHost offers a 7-day money-back guarantee for our shared hosting services.

Eligibility

Refund requests must be submitted within 7 days of service activation. All refund requests will be evaluated on a case-by-case basis.

Refund Conditions

  • Full Refund: If no services have been used or if the service was found to be faulty, a full refund may be issued.
  • Partial Refund: In cases where some services have been used, a partial refund may be issued.
  • No Refund: For reasons such as service misuse or violation of the Acceptable Use Policy, a refund may not be issued.

Non-Refundable Items

  • Domain Name registration/transfer fees
  • Custom setup fees (if applicable)

Refund Process

To request a refund, clients must contact our support team via our support ticket system. Refund requests will only be processed if received within 7 days of service activation.

8. Uptime Guarantee

EterniHost offers an uptime guarantee of 100% per month. In the event that this uptime is not met, clients may request a credit for the amount of downtime.

Exclusions

Credits are not provided for:

  • DDoS (Distributed Denial of Service) attacks
  • Scheduled maintenance
  • Reboots or hardware maintenance
  • Other exceptional circumstances beyond our control

To receive a compensation credit, clients must submit a request by opening a support ticket or by emailing support.

Please note that we rely on third-party DDoS protection services to mitigate attacks. As such, we cannot guarantee a specific level of protection against large-scale DDoS attacks.

9. Limitation of Liability

EterniHost is not responsible for any damages resulting from service outages, data corruption, or loss of data. Our liability is limited to the termination of the service for which you are billed, and no liability is assumed for any other damages.

10. Late Payments

All services are billed from the date of activation. If payment is not made within 5 days after the due date, your service may be suspended. If payment is not made within 30 days, services will be terminated.

Services suspended for late payment can be reactivated by paying the overdue invoice through the client area.

11. Disclaimer

EterniHost cannot be held liable for any system downtime, crashes, or data loss. We reserve the right to terminate, suspend, or cancel any client account or service without notice or refund. We also retain the right to change any policies, guidelines, or this disclaimer at any time without prior notification.

EterniHost is not responsible for any client’s files, data, or actions. Accounts violating our terms or policies may be deactivated without prior notice.

12. Changes to Terms

EterniHost reserves the right to amend these Terms of Service at any time. Clients will be notified of any changes via email or the website. Continued use of our services signifies your acceptance of the revised terms.
